These terms apply to lawn and landscape maintenance services provided by Lawn and Yard Solutions ("we," "us," "our") to you, the property owner or authorized resident ("you"). By requesting service, agreeing to an estimate, placing a payment method on file, or allowing us to perform work at your property, you accept these terms.
We serve Tracy and Mountain House, California, and the area between them. If your address falls outside that area, we will let you know and no service agreement is formed.
Prices are based on the physical size of the lawn to be mowed, the number of shrubs to be trimmed, and the actual area that needs service for weeding, weed control, and any other work you have chosen. Those prices are built from the equipment required, the cost of the products used, and the average time needed to complete the agreed-upon tasks when service runs consistently through the year.
The time actually spent varies across the year with the season, how fast the lawn is growing, how many leaves are down, and how active the weeds are. Your price is averaged across the maintenance plan for the year and quoted as an average amount per service visit, so it stays the same from visit to visit rather than rising and falling with the season. Changing your schedule or your services changes that average, and therefore your price.
Prices shown on our website and pricing calculator are estimates based on the information provided. Your final price is confirmed at a free on-site estimate, where we can see the actual condition, access, slope, and layout of your property. Estimates assume the lawn is not overgrown beyond six inches and is otherwise in a condition where the selected work can be completed in the normal amount of time. A lawn that is overgrown, or that needs substantially more labor than the estimate assumed, is quoted separately before we do the extra work.
A minimum mowing charge applies regardless of lawn size. The current minimum is stated on our pricing page.
Mowing frequency should follow how fast the grass is growing. A lawn should be mowed often enough that no more than one third of the length of the blade is removed at a time. Taking off more than that depletes the food reserves in the plant, which makes it harder for the lawn to recover from stress and injury and leaves it more open to several turf diseases.
During the growing season, typically February 1 through October 31, weekly mowing is recommended. Once growth slows, bi-weekly service is usually enough. If you have added services that depend on us seeing the yard regularly, staying on weekly service through the season lets us spot problems early and deal with them before they get out of hand.
Your service day and time may change as routes are adjusted. If your day changes, we will let you know, so that you can have the lawn ready for the new day.
Extreme or prolonged rainfall, extreme heat, high wind, equipment failure, or any condition that would make the work unsafe may move a visit to the next available day. We will let you know when that happens.
So that we can work safely and finish the visit as scheduled, please have the following ready before we arrive.
Please have garden hoses, children's toys, dog toys, sports equipment, furniture, and similar items off the lawn before your service day.
We do not pick up or move personal items. Anything left on the lawn is mowed around, and the area underneath and immediately around it is left uncut. We do not move trampolines, play structures, slides, portable goals, or similar equipment at any time — moving them is the property owner's responsibility. Where scattered items add significant time to a visit, an additional charge may be added for that time.
All dogs must be indoors, or secured in a run or other enclosure well away from the area where we will be working, for the entire visit. This protects your pet and our crew. If a dog is loose in the work area when we arrive, we will not enter that area. Securing pets and gates is the property owner's responsibility, and we are not responsible for a pet that leaves the property through a gate or door during a scheduled visit.
Please pick up the lawn before each scheduled visit. Any area containing animal waste will be skipped, and the visit will be billed as scheduled. We will tell you which areas were skipped and why.
If your service includes the backyard, please make sure the gate is unlocked and the pathway is clear enough to bring equipment through. Some customers prefer to give us a key so we can unlock the gate and lock it again after service; we are glad to work that way.
Please make sure there is room in your green waste container on your service day. If there is not and we haul your yard waste away for disposal, a charge of at least $5.00 applies, based on the volume we have to haul and dispose of.
You know what is in your yard; we do not. Before service begins, and any time something new is installed, please identify and mark anything in or just under the lawn that we would not be able to see — sprinkler and irrigation heads, valve boxes, drip lines, low-voltage and landscape lighting, shallow wiring or cable, invisible fence wire, septic or utility lids, decorative edging, stakes, ground markers, and anything similar.
We are not responsible for damage to objects that are hidden, buried, unmarked, obscured by grass growth, or otherwise not clearly guarded, marked, or pointed out to us. The same applies to items sitting at or above the height of the turf where a mower or trimmer will reach them, including sprinkler heads that do not retract or that sit high, and to items that have settled, shifted, or were already damaged before our visit. Repair and replacement of those items is the property owner's responsibility.
We take every reasonable precaution to do high-quality work with minimal disruption. Even so, we are not responsible for the following.
Incidental damage during routine service to sprinkler heads, irrigation lines or components, exposed cable or wiring, and landscape lighting, on the terms set out in section 6. Damage to personal items left on the lawn or in the service areas. Damage arising from pre-existing conditions such as loose pavers, unstable fencing, or deteriorated turf. Damage from flooding, storms, wind, heat, or cold. Disease or damage to lawns or landscape plants caused by too much or too little water, whether from irrigation settings, irrigation components that are not working, or watering restrictions imposed by the city or other authorities. Damage caused by vandalism.
What we are responsible for is damage we cause through our own fault to things that were visible or that you told us about. If that happens, tell us promptly — we are licensed and insured, and we will make it right.
Ordinary seasonal leaf fall is part of normal service. The extra time it takes to mow and clean up through the fall is already built into your annualized price, so a typical fall costs you nothing extra.
Some properties are well beyond typical — large lots, corner lots, or yards under heavy mature tree cover, where the volume of leaves adds substantial time to every visit through the season. For those properties we reserve the right to add a fall leaf surcharge, starting at $15.00 per visit and set according to the actual volume. If your property is one of them, we will tell you before the season starts and before any surcharge appears on an invoice. It is never added after the fact.
Clearing a full autumn drop from the whole property, including planting beds and the areas outside the lawn, is a separate Leaf & Seasonal Cleanup visit rather than part of a regular visit. Your regular visits keep the lawn mowed and the driveway, walkways and patio blown off; a cleanup visit is what takes the property back down to clear ground once the trees have finished dropping.
Adding yard lights, plants, play equipment, planting beds, or other features after your original quote may increase your price, since those items take extra time and care to work around and maintain. Tell us when something has been added and we will let you know whether it changes your price before the next visit.
Applications are performed under a California Maintenance Gardener Pest Control Business license with Qualified Applicator Certificate (QAC-Q) certification, using properly labeled, non-restricted materials, and in accordance with county registration requirements.
Before service begins, we send a pre-notification listing the products that may be used at your property, for your review and signature.
We follow integrated pest management, using the least aggressive method that will do the job, applied only where it is needed. We do not spray in or next to vegetable gardens or other edible plants. Tell us about any area you want left alone and we will skip it.
We do not guarantee that weeds will not return. Weed seed blows in and germinates throughout the season, which is why treatments run on an ongoing schedule rather than as a one-time fix.
If you would prefer that we not spray on your property, tell us and we will use non-chemical methods where we can.
Some services, such as lawn fertilization and weed control programs, are applied several times a year on their own schedule rather than at every visit. The annual cost of those programs is spread evenly across your visits, which is why your per-visit price stays the same year-round. If you cancel partway through a program year, we will settle up for the treatments actually applied.
Payment is handled through autopay. We send a secure link by email for you to store your debit or credit card yourself. We never collect card information on our website, over the phone, or in person — the secure link is the only way a card is added.
Your card is not charged until services are provided. Once payment is processed you receive a confirmation and a paid invoice by email. Placing a card on file starts your service and is treated as acceptance of these terms.
Payment is due on completion of services. If a payment does not go through, service may be suspended until the unpaid balance is received. On any invoice not paid in full, a late charge of 0.8333% per month (10% per year) is applied to the unpaid balance. The unpaid balance is calculated by taking the beginning balance of your account for the month, adding new charges, subtracting payments received, and multiplying the result by the 0.8333% monthly rate.
Please give us at least 24 hours' notice to skip or reschedule a visit. If we arrive as scheduled and cannot do the work because the property was not ready, a gate was locked, a dog was loose in the work area, or we were turned away, the visit is billed as scheduled.
Recurring service continues until you tell us to stop. You may cancel at any time; please give us notice before your next scheduled visit so we can take you off the route.
We photograph work we have performed for our quality records, and those photographs may be posted on our website or social media. They may include your property. We do not publish your name or address. Tell us at any time if you would prefer that your property not be included and we will leave it out.
We may decline or discontinue service at a property where conditions are unsafe, where pets are repeatedly not secured, where the property is not prepared as described in section 5, or where the work cannot be performed as agreed. We will tell you why and give you notice where we reasonably can.
We are responsible for performing the work with reasonable care and skill. Except where the law does not allow it to be limited, our liability for any claim arising out of our services is limited to the amount you paid us for the service in question. Nothing in these terms limits liability that cannot be limited under California law.
We may update these terms. The version number and effective date at the top of this page tell you which version is current. Material changes affecting ongoing service will be communicated to active customers before they take effect. The version you agreed to when you signed up continues to apply to you until you are notified of a change.
These terms are governed by the laws of the State of California, and any dispute will be handled in the state or federal courts serving San Joaquin County, California.
Protect yourself, your property, and the environment by making sure whoever you hire is properly licensed and insured.
If they apply any herbicide, pesticide, or insecticide — fertilizer with weed control, weed spraying in rocks or beds, or anything that controls pests or disease on your lawn, plants, or home — both the business and the individual must be licensed by the California Department of Pesticide Regulation. It is illegal to make those applications without that license.
You can ask to see the license, or look it up yourself on the state's list at cdpr.ca.gov. The lookup is near the end of that page under the Reports heading, and you can check both the business and the individual.
Lawn and Yard Solutions is fully licensed and insured.
